Driving without a valid mandatory motor third-party liability insurance (RCA) policy in Romania is a serious violation of traffic law and is penalized immediately. It is vital to note that there is no grace period after the expiration date of your insurance policy; driving the vehicle becomes illegal from the very first second of the day following expiration.

1. Fines & Contravventions

According to traffic legislation and Law 132/2017, driving a vehicle without an active RCA insurance policy attracts a fine between 1,000 and 2,000 RON (approx. 200 - 400 Euros) for individuals.

For legal entities (for example, commercial fleets), penalties are significantly harsher, with fines reaching up to 20,000 RON (approx. 4,000 Euros). If the fine is paid within 15 days, the offender benefits from paying half of the legal minimum.

2. Complementary Sanctions (Vehicle Impoundment)

Traffic police officers will not only issue a fine, but will immediately remove the vehicle from circulation through mandatory measures:

• Confiscation of the registration certificate (Talon): The document is confiscated on the spot, and the driver receives a temporary replacement receipt without driving rights.
• Removal of physical license plates: The registration plates are unbolted and retained by police officers on site.

From this moment, the vehicle is immobilized and cannot be driven on public roads; it must be transported via a tow truck exclusively to a private property.

3. Automatic Registration Suspension (The 90-Day Rule)

With modernized control systems, the state continuously monitors insurance databases. If a registered vehicle does not show an active RCA policy in the national database (AIDA) for 90 consecutive days, its official registration is automatically suspended by law.

During the entire period of suspension, the law mandates the owner to keep the vehicle parked on private property (garage or driveway), strictly prohibiting parking on public roads. Prolonged non-compliance over multiple years can result in ex-officio deregistration of the car.

The traffic fine is a minor issue compared to the financial risk of causing an accident without valid RCA insurance. Procedurally, victims will initially be compensated by the Motor Insurers’ Bureau of Romania (BAAR) through the Street Victims Protection Fund. How to recover your registration certificate and license plates

If you have been penalized, recovering your documents and driving rights requires completing the following steps:

1. Issue a new RCA policy: You must purchase a valid policy for a minimum duration of 6 or 12 months.
2. Pay the fine: Ensure you retain official proof of payment for the traffic fine.
3. Present documents at Traffic Police headquarters: Visit the competent police unit counters with your new RCA policy and proof of fine payment. Only upon presenting these documents will police release your registration certificate and license plates.
